Family Law Attorneys Helping You Resolve Property Division Disputes

Whether it is a pension or 401(k) account, a family home or a treasured heirloom, marital assets can be difficult to divide. In fact, how to split assets and debts is often one of the most-contentious issues in a divorce.

If you are facing divorce and the division of your marital property, the attorneys at the law office of David J. Crandall can help. Our law firm will work to protect your property rights and interests throughout the entire divorce process. We have been representing clients in Calabasas, and throughout Los Angeles County and Ventura County for more than three decades.

Protecting Your Property Rights in a Divorce

In addition to his 35 years of experience as an attorney, David J. Crandall is also a licensed real estate broker. His knowledge of California real estate, home values, property appraisals, refinancing and modification of home mortgages can be of great benefit to you in your divorce. In addition, his in-depth knowledge of real estate law can help you with the division or sale of your home, business assets or other real property.

California is a community property state. This means that, with very few exceptions, all of a couples' property will be split equally between the husband and the wife.

Our divorce attorneys know the exceptions to the rule. They know when property is protected by a premarital agreement or when an asset should be given to one spouse because it is separate property.

Whenever possible, we will try to help you reach a fair agreement with your husband or wife regarding property division. If you can't agree, we will vigorously protect your rights in court. Our firm can help you resolve a variety of property division issues, including:

  • Who Gets the House? The home is often a couple's most valuable asset. In the past, couples fought over who would get to keep the house. In this tight real estate market, however, some couples are fighting over who has to stay in the home when they can't sell it.
  • How Do We Divide the Retirement Accounts? There are many complicated rules governing the division and transfer of pensions, 401(k)s, IRAs and other retirement accounts. The attorneys at our firm know how to obtain proper valuation of pension and retirement accounts and split the accounts using Qualified Domestic Relations Orders.
  • How Do We Split Up Personal Property? We advise our divorce clients about mediation, arbitration and other cost-effective methods for resolving disputes over furniture, cars, boats, household goods and other personal property.

Keeping Your Emotional and Financial Costs Down

When handling a divorce, our firm doesn't try to drag things out just so we can charge more legal fees. Whenever possible, we strive to help couples resolve their property division and other divorce issues as quickly as possible. We believe that this approach can keep the emotional and financial costs of a divorce to a minimum.
