Spousal Support

In California, spousal support (also known as alimony) may or may not be awarded in a divorce. Whether a spouse should receive spousal support and the amount of support awarded is at the sole discretion of the family court judge.

Do you feel you need temporary financial support from your spouse in order to ease the transition to single life? Is your spouse requesting an award of permanent spousal support?

Types of Spousal Support in California

In some cases, one spouse does not have the financial resources to retain an attorney or to support him or herself during the divorce. In these circumstances, the court can order one spouse to pay temporary spousal support while the divorce is pending. In California, temporary support is usually determined by using DissomasterTM, an advanced software system.

In other marriages, one spouse may need rehabilitative support in order to obtain additional training, education or work experience. In some long-term marriages, the court may award permanent spousal support after considering many factors including:

  • Length of the marriage
  • Skills of the dependent spouse
  • Health of the dependent spouse
  • Lifestyle during the marriage
  • Earning capacity of both husband and wife
  • Income producing assets
  • Ability to work

While alimony or spousal support is often hotly disputed, it is possible to find creative, mutually-acceptable solutions. By resolving the issue through an out-of-court settlement, both parties can save attorneys fees, legal costs and emotional stress.
